1. Luna was under criminal investigation for failure to report child abuse
•The DA’s office confirmed that Luna was under criminal investigation for failure to report child abuse while he was testifying in the 2018 Sergio Guzmán trial.
•The IA investigation began April 16, 2018 and lasted until June 2018while he was still on the gang task force.
•This was a direct violation of California’s mandatory reporting laws for peace officers.

2. No charges filed, but Luna was fired anyway
•While the investigation didn’t result in criminal charges, Luna was terminated from Cathedral City Police on Jan 7, 2019, according to then–Police Chief Travis Walker.
•City Manager Charlie McClendon confirmed to The Desert Sun that Luna was fired, not resigned.
•The department did not cite timecard fraud as the reason for termination.

3. Timecard fraud existed but was not the cause of removal

4. Failure to report child abuse is a crime under CA law for police
•California law mandates that all peace officers are legally obligated to report any known or suspected child abuse or neglect immediately.

5. Luna’s testimony during trial was compromised
•In 2015, Luna testified in the Sergio Guzmán trial without disclosing he was under investigation.

•Guzmán was later retried without Luna’s testimony and received a lighter sentence.
