More than 60,000 people have been arrested in Britain for “communications offenses” over just five years, exposing what free-speech campaigners are calling an “Orwellian” system of policing online expression.
A new report from civil liberties group Big Brother Watch found that at least 62,199 people have been arrested for communications offences since 2021.
Of those arrested, 18,150 were charged, and 12,292 were ultimately convicted.
The offences covered by Britain’s sweeping communications laws can include activity involving social media platforms such as TikTok.
While some cases involve genuine threats and abuse, including abusive partners sending threatening messages, campaigners warn that the extraordinary breadth of Britain’s speech laws has allowed police to arrest thousands of people over controversial opinions, jokes and peaceful expression.
The figures mean fewer than one in five of those arrested ultimately received a conviction.
‘Why Are Authorities Policing Our Tweets Instead of Our Streets?’
Lord Toby Young, director of the Free Speech Union, questioned why police resources are being poured into monitoring speech while conventional crimes continue to plague communities.
“Why are the authorities spending so much time policing our tweets when they could be policing our streets?” Young wrote in The Mail on Sunday.
“Shoplifting, mobile phone theft and sexual offences are all on the rise,” he added.
Young warned that the sheer scale of the arrests itself poses a threat to freedom of expression, regardless of how many cases eventually result in convictions.
“The sheer number of people being arrested for online offences, even though only one in five end up being convicted, cannot help but have a chilling effect on free speech,” he said.
That distinction is critical.
An arrest does not need to end in prison, or even a prosecution, to send a message.
Being questioned by police, taken into custody and investigated over something said online can itself discourage ordinary citizens from expressing lawful but controversial opinions.
Huge Differences Expose Britain’s Vague Speech Laws
Big Brother Watch said the enormous variation in enforcement between different police forces illustrates the “elasticity of vaguely defined speech offences.”
The numbers vary dramatically even between neighboring jurisdictions.
Cumbria Police recorded 25.7 arrests per 10,000 people during the period examined.
Neighboring Northumbria recorded just 1.9.
Such an enormous disparity raises questions about how consistently Britain’s speech laws are being interpreted and whether conduct capable of triggering arrest in one part of the country could pass without police intervention somewhere else.
Big Brother Watch Director Silkie Carlo said public concern over Britain’s approach to policing speech has reached a breaking point.
“There is mounting concern among the public that speech policing is out of control in Britain and it’s long overdue that the government takes action,” Carlo said.
“Andy Burnham must now launch a free speech reset and order an independent review of our laws and police training around speech, in order to fix this Orwellian mess.”
‘Thousands’ Arrested Over Speech, Jokes and Peaceful Protest
Carlo warned that Britain’s speech-policing apparatus has expanded far beyond cases involving genuine threats of violence.
“Thousands of people are being arrested for controversial speech, online jokes and non-violent protest,” Carlo said.
“People have even been arrested for holding blank pieces of paper, and urged to take ‘online thinking skills’ courses by police.
“Enough is enough,” Carlo warned.
The report adds hard numbers to a controversy that has increasingly damaged Britain’s international reputation as a country committed to freedom of expression.
The issue is not whether genuine threats, harassment or abuse should be ignored.
It is whether police should wield vaguely defined communications laws so broadly that tens of thousands of citizens are arrested while only a fraction are ultimately convicted.
More than 62,000 arrests in five years is no longer a collection of isolated cases.
It is a system.
And when citizens begin wondering whether a joke, social media post, peaceful protest, or other online activity could bring police to their door, the chilling effect reaches far beyond those who actually end up in court.
