Former Vice President Mike Pence is reportedly expected to fight a subpoena in the Justice Department special counsel’s investigation of former President Donald Trump and Pence’s role in the Jan. 6 Capitol riot.
He is expected to argue that as president of the Senate at the time, he is shielded by the Constitution’s Speech or Debate Clause, a source familiar with the matter told CNN on Tuesday.
He has made such an argument before about not testifying before Congress and reportedly plans on discussing his response to the subpoena Wednesday during a trip to Iowa.
Special counsel Jack Smith reportedly subpoenaed Pence last week in an attempt to force the former vice president to testify about his conversations with Trump regarding the 2020 election and the events at the U.S. Capitol on Jan. 6, 2021.
The subpoena comes as Pence considers mounting a 2024 presidential bid.
