Trump files FEC complaint over Biden transferring campaign war chest to Kamala Harris

Former President Donald Trump filed a complaint on Tuesday with the Federal Elections Commission (FEC), over President Joe Biden transferring his campaign funds to Vice President Kamala Harris’ presidential campaign.

Biden withdrew from the presidential race on Sunday after facing pressure from Democratic leadership and House members, and endorsed Harris for the top ticket slot instead.

The complaint attempts to block Harris from accessing the war chest, and comes after the Biden campaign account changed its name to “Harris for President” on Monday. The money would be on top of the over $80 million haul Harris raised on Monday, after she received the president’s endorsement.

“Kamala Harris is seeking to perpetrate a $91.5 million heist of Joe Biden’s leftover campaign cash — a brazen money grab that would constitute the single largest excessive contribution and biggest violation in the history of the Federal Election Campaign Act of 1971,” Trump campaign counsel David Warrington wrote in the eight-page filing, per The Hill.

The filing requests a criminal investigation into the effort, claiming that renaming the campaign and sending the money to Harris is a form of fraud. But most experts are skeptical of the argument, since Harris’s name was on the original ticket as the vice president.

The complaint also claims the donations should now be “disposed of” because Biden withdrew from the race, and that the transfer of funds to Harris are unlawful because “Biden for President” was not a committee of Harris’ campaign.

“Federal candidates are prohibited from keeping contributions for elections in which they do not participate,” the filing said, according to The Guardian. “Biden for President 2024 has shown no intention to properly refund or re-designate the general election funds it has already received. This makes them all excess contributions.”

“If Mr. Biden will not seek the Democratic party’s nomination, then he will never participate in the general election and all general election contributions received by Biden for President are excessive and must be disposed of,” it added.
