The plea deal for the 53-year-old first son failed in July.
The Delaware Grand Jury charges include two related to knowingly making a “false and fictitious written statement” by declaring that he was not using drugs, specifically crack cocaine, when he purchased a firearm and another charge of possessing a firearm while using and being addicted to a drug.

Further charges may be filed against Biden for failing to pay his taxes on time, the special counsel overseeing his case indicated, according to The Associated Press.
The latest indictment does mention any tax crimes, though two tax charges would have been covered under the plea deal that Biden had tentatively reached with prosecutors.
The judge raising concerns about the deal’s constitutionality and whether it protected Biden from future penalties for charges.
